  • Planning probate strategy

  • Representing Executors, Administrators, and interested parties in court

We take the time to understand your family, your concerns, and your objectives, providing a personalized approach to every probate case.

How Probate Administration Works

The probate process in Nigeria generally involves the following key steps:

  1. Filing an Application for Probate
The Executor named in the Will applies to the appropriate Probate Registry for the issuance of Grant of Probate.

  2. Serving Notice
Notice of the application is served to interested parties. If the Executor resides outside the jurisdiction, a resident agent may be appointed to receive notices and documents on their behalf.

  3. Appointment of an Attorney or Guardian (if needed)
If there are missing heirs, minors, or persons with legal disabilities, the court may appoint a legal representative to protect their interests.

  4. Court Hearing
The Probate Registry reviews the Will and hears any objections. If there are no disputes, the court grants the Grant of Probate to the Executor, legally empowering them to manage and distribute the estate.

  5. Taking Oath and Letters of Administration
The Executor takes an oath of office and receives the official letters authorizing administration of the estate.

  6. Public Notice
A notice of probate is published to inform creditors and other interested parties, reducing the risk of future claims.

Independent vs. Supervised Probate Administration

Depending on the complexity of the estate and potential disputes:

  • Independent Administration: The Executor has full authority to administer the estate, distribute assets, and manage property without court supervision.

  • Supervised (Dependent) Administration: The court closely oversees the administration, requiring detailed reports, accounting, and prior permission for certain actions. This is common when there are disputes, unknown heirs, or minor beneficiaries.

Regardless of the administration type, our team ensures full compliance with Nigerian law and court requirements.

Key Responsibilities of the Executor

Once granted probate, the Executor is responsible for:

  • Taking possession and control of the estate property

  • Opening estate bank accounts

  • Notifying beneficiaries, tax authorities, and creditors

  • Preparing and filing a full inventory of estate assets

  • Paying debts and liabilities in accordance with the law

  • Filing estate tax and final income tax returns (if applicable)

  • Distributing property to beneficiaries in accordance with the Will

At Uzochukwu Chambers (Operating as APEXA ATTORNEYS), we provide hands-on guidance at every stage to ensure the estate is administered accurately, legally, and efficiently.
