Who Inherits Without a Will?

If There is a Surviving Spouse

  • Spouse: Typically entitled to a statutory share or life interest in estate property

  • Children: Share the remaining estate equally

If There is No Spouse

  • Children: Inherit the estate in equal portions

  • If no children, the estate passes to parents

  • If no parents, the estate passes to siblings, then to more distant relatives such as grandparents or cousins, according to customary or statutory rules

The Heirship Process in Nigeria
